SECTION 02 — TERMS CONTENT

01About These Terms

These Terms and Conditions apply to the use of this website and to enquiries or commissions placed with Maiyi Wax Atelier. By using the website, submitting an enquiry or confirming a quotation, you acknowledge that you have read and understood the terms relevant to your project.

A commission becomes binding only when the scope, quotation, payment schedule and any project-specific conditions have been confirmed in writing.

02Enquiries and Quotations

Initial enquiries may be submitted through WhatsApp or any other contact method displayed on this website. To prepare an appropriate recommendation, we may request reference photographs, the intended display setting, approximate scale, preferred completion timeframe and delivery destination.

Quotations are based on the information available at the time they are issued. A quotation may be revised if the scale, materials, costume, pose, delivery requirements or other parts of the project change.

Unless otherwise stated in writing, submitting an enquiry does not reserve a production slot or require either party to proceed.

03Bespoke Commissions

Each wax figure is produced as a bespoke work. Minor differences in colour, texture, proportion and hand-finished details are natural characteristics of individually crafted work and do not necessarily constitute defects.

The final result depends on the quality and completeness of the references supplied by the client. Where photographic or historical references are limited, the atelier will use professional judgement to interpret the available material.

04References and Client Materials

The client is responsible for ensuring that photographs, logos, costumes, artwork and other materials supplied for a commission may lawfully be used for that purpose.

By supplying reference material, the client confirms that its use will not infringe another person’s copyright, privacy, publicity, trademark or other rights.

Original materials supplied to the atelier will be handled with reasonable care. Any arrangements for their return should be confirmed before the project begins.

05Approvals and Changes

Progress images may be provided at agreed stages so that proportion, expression, hairstyle, costume and styling can be reviewed.

The client should provide clear and consolidated feedback within the agreed review period. Delayed feedback may affect the production schedule.

Reasonable refinements within the approved scope may be included. Significant changes to the subject, pose, scale, costume, materials or concept may require a revised quotation and completion date.

Once a stage has been approved and production has progressed, reversing that stage may not be possible.

06Pricing and Payment

Prices are confirmed individually for each commission and may depend on scale, complexity, materials, costume, accessories, delivery and installation requirements.

The quotation will specify the required deposit, payment schedule, accepted payment methods and any applicable delivery charges.

Production will normally begin only after the required initial payment has been received. The completed work may be withheld from dispatch until all amounts due under the confirmed quotation have been paid.

Any bank, transfer, currency-conversion, customs or intermediary charges are the responsibility of the party identified in the quotation.

07Production Times

Production estimates are provided in good faith but may vary according to the complexity of the work, availability of materials, approval timing and circumstances outside the atelier’s reasonable control.

A completion estimate is not a guaranteed delivery date unless this has been expressly confirmed in writing.

The atelier will communicate significant changes to the expected schedule as soon as reasonably possible.

08Delivery and Installation

Packing and delivery are planned according to the figure’s size, materials, destination and placement requirements.

The client is responsible for providing accurate delivery information and for disclosing access restrictions, lifting requirements, building rules or installation conditions before dispatch.

International deliveries may be subject to customs procedures, import duties, local taxes or inspection delays. Responsibility for these charges will be stated in the quotation or delivery agreement.

The client should inspect the crate and work promptly after delivery and report visible transit damage, together with photographs, as soon as reasonably possible.

09Cancellations and Refunds

Because each commission is made specifically for an individual client, cancellation and refund arrangements depend on the stage reached when cancellation is requested.

Payments relating to consultation, design, materials, completed labour, third-party services, packing or other costs already incurred may be non-refundable.

If a project is cancelled, the atelier will provide a reasonable account of work completed and costs committed. Any refund or remaining balance will be determined according to the confirmed quotation and the circumstances of the cancellation.

Nothing in these Terms excludes any mandatory consumer rights that apply under relevant law.

10Intellectual Property

Unless otherwise agreed in writing, Maiyi Wax Atelier retains copyright and other intellectual property rights in its original designs, production methods, photographs and creative materials.

Ownership of the physical commissioned figure does not automatically transfer copyright in the design or production documentation.

The atelier may request permission to photograph and display completed work in its portfolio, website, exhibitions or promotional materials. Confidentiality or publication restrictions should be agreed in writing before production begins.

11Website Use

The content of this website is provided for general information and presentation of the atelier’s work. Images, text, graphics and branding may not be copied, reproduced, republished or commercially used without permission.

Users must not attempt to interfere with the website’s operation, security or availability, or use it for unlawful or misleading purposes.

We may update, suspend or remove website content without prior notice.

12Liability

The atelier will exercise reasonable care and skill in providing its services.

To the extent permitted by applicable law, Maiyi Wax Atelier will not be responsible for indirect or consequential losses, loss of opportunity, delays caused by third parties or damage resulting from handling, storage, installation or environmental conditions contrary to the guidance supplied.

Nothing in these Terms limits liability where such limitation would be prohibited by applicable law.

13Privacy

Personal information submitted through this website or during an enquiry will be handled in accordance with the website’s Privacy Policy.

Clients should avoid sending unnecessary sensitive personal information through unsecured communication channels.
